About the terms
1.1 These Terms of Use are an agreement which sets forth the terms and conditions governing access to and the use of LittleGives website www.littlegives.co (Platform) owned and operated by Sarah James and Vitalii Tokariev (Platform Owners). The intellectual property rights in the Platform and in any text, images, video, audio or other multimedia content, software or other information or material submitted to or accessible from the Platform are owned by Platform Owners.
1.2 Platform Owners and User may be individually referred to herein as a “Party” and together the “Parties.”
1.3 By using the Platform or otherwise indicating your consent, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should stop using the Platform immediately.
1.4 The Platform and Terms of Use may be modified at any time by Platform Owners.
2. Intended Audience
2.1 The Platform is intended for adults only. The Platform is not intended for any individual under the age of eighteen (18).
3. Links To Third-Party Websites
3.1 The Platform may contain links to third-party websites that are not owned or controlled by Platform Owners. Platform Owners assume no responsibility for such content, terms, and conditions, privacy policies, or practices of any third-party websites. In addition, Platform Owners do not censor or edit the content of any third-party website. By using the Platform, User expressly releases Platform Owners from any and all liability arising from User use of any third-party website.
4. Using the Platform
4.1 We offer an online intermediary hosting service and possibility of communication between registered users.
4.2 Registration on the Platform constitutes the User agreement on sharing their suburb and email address with other registered users.
4.3 The Platform is for User’s own personal and non-commercial use only.
4.4 The User agrees not to copy materials on the Platform, reverse engineer or break into the Platform, or use materials, products or services in violation of any law.
4.5 The Platform Owners may terminate User’s use of the Website at any time.
4.6 The User agrees that they are solely responsible for all costs and expenses they may incur in relation to your use of the Platform.
4.7 The Platform is appropriate for use in locations inside Australia.
4.8 The User agrees that use of the Platform is at user’s sole risk. User’s sole and exclusive remedy relating to user’s use of the Platform shall be to discontinue using the website.
4.9 The User is fully responsible for all the information posted on the Platform and, if applicable, for the items they offer, give, receive or transfer to other registered users.
4.10 Under no circumstances will Platform Owners be liable or responsible for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages, under any legal theory, arising out of or in any way relating to the Platform, The User’s use of the Platform, or the content, even if advised of the possibility of such damages. The User’s sole remedy for dissatisfaction with the Platform and/or content is to cease use of the Platform.
4.11 Any personal information provided by the User as part of the registration process will be processed in accordance with our Privacy Policy.
4.12 Platform Owners shall use commercially reasonable efforts to attempt to provide this Platform available on a twenty-four (24) hours a day, seven (7) days a week basis. The User acknowledges and agrees that from time to time this Platform may be inaccessible or inoperable for any reason including, but not limited to, equipment malfunctions; periodic maintenance, repairs or replacements; or causes beyond our reasonable control or that are not reasonably foreseeable including, but not limited to, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures.
5. Listing and requesting items
5.1 The User (Giver) may list the following items on the Platform: children’s clothes, children’s books, toys and accessories.
5.2 The Giver must be the owner of the items they list.
5.3 The Giver must describe it as accurately as possible, indicating any defects and stating the condition of the item.
5.4 The Giver must upload at least one photograph, made by themselves, showing the general view of the item and possible defects. It is forbidden to upload any images on which people other than User are visible, and which are or may be considered contrary to good moral standards and/or public order.
5.5 If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
5.6 The Giver may withdraw a listed item at any time.
5.7 Listing an item on the Platform by the Giver constitutes an offer for the giving of this item for free, which gives another registered the User (Receiver) the right to request this item.
5.8 The offer and acceptance are agreed upon independently between the Giver and the Receiver. The platform is not a party of the agreement between the Giver and the Receiver.
